1. Acceptance of these terms

These Terms and Conditions govern your use of the Variable Steel website and your submission of quote requests, orders, and related communications with Variable Steel ("we," "us," or "our"). By submitting a quote request or placing an order, you agree to these Terms. If you do not agree, please do not submit a request or place an order.

2. Quotes are estimates

Quotes we provide are estimates based on the information you submit and on material availability and market pricing at the time of the quote. A quote is not a binding offer and does not reserve material. Pricing, availability, and lead times can change until we confirm your order in writing. Weights and tonnage shown on the site are calculated from published nominal weights and are provided for planning only.

3. Orders, invoicing, and payment

We price and confirm each request, then invoice through QuickBooks. An order is accepted only when we confirm it in writing and issue an invoice. Payment terms are stated on your invoice. Title and risk of loss are addressed in Section 5. Applicable sales tax will be added unless you provide a valid Georgia resale or exemption certificate.

4. Custom fabrication and cutting

Custom cut lengths are held to a tolerance of plus or minus one eighth inch (1/8") to account for saw kerf. You are responsible for the accuracy of the sizes, cut lists, quantities, drawings, and specifications you submit. Custom cut and custom fabricated material is made to your order and is non-returnable and non-refundable. Please confirm your take-off before submitting.

5. Delivery, freight, and pickup

Freight amounts shown before your order is confirmed are estimates only and are finalized on your quote or invoice. Delivery dates are estimates and are not guaranteed. Will-call pickup is available at our yard in the metro Atlanta area by appointment. For delivered orders, risk of loss passes to you upon delivery to the carrier or to the shipping address, whichever occurs first. For pickup orders, risk of loss passes to you when the material is loaded or released.

6. Returns and cancellations

Standard, uncut stock material may be eligible for return within a reasonable period, subject to inspection and a restocking fee, and must be unused and in resalable condition. Custom cut, custom fabricated, and surplus or as-is material is not returnable. Cancellation of a confirmed order may be subject to charges for material and work already incurred.

7. Material specifications, grades, and surplus

We identify material by common grades and nominal dimensions. Mill test reports and certifications are available on request for applicable material. Surplus and remnant material is sold as-is, may have mill finish, surface conditions, or dimensional variation, and is not warranted for any particular use.

8. Warranty disclaimer

Except as expressly stated in a written agreement signed by us, all material and services are provided as-is and as-available. To the fullest extent permitted by law, we disclaim all warranties, express or implied, including implied warranties of merchantability and fitness for a particular purpose. You are responsible for confirming that the material and specifications you order are suitable for your intended use.

9. Limitation of liability

To the fullest extent permitted by law, Variable Steel is not liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, arising out of or related to your use of the site, a quote, or an order. Our total liability for any claim will not exceed the amount you paid for the specific material or service giving rise to the claim.

10. Communications and marketing consent

When you submit a quote request, we may contact you about that request and your account by email, phone, or text. If you opt in to our email list, you consent to receive marketing and promotional emails from Variable Steel, such as product updates, surplus availability, and promotions. You can unsubscribe at any time using the link in any marketing email, and unsubscribing from marketing does not affect messages we send about an active request or order. We send email through our email service provider and do not sell your contact information.

11. Privacy

We collect the contact, shipping, and project information you provide in order to prepare quotes, fulfill orders, and communicate with you. We use reasonable measures to protect your information and share it only with service providers who help us operate the business, for example payment, email, file storage, and shipping providers. Attachments and files you upload are used solely to prepare your quote and fulfill your order.

12. Acceptable use

You agree not to misuse the site, submit false information, interfere with its operation, or attempt to gain unauthorized access to any system. We may decline or cancel any request or order at our discretion.

13. Changes to these terms

We may update these Terms from time to time. The Last updated date above shows when they were last revised. Your continued use of the site or submission of a request after changes take effect constitutes acceptance of the updated Terms.

14. Governing law

These Terms are governed by the laws of the State of Georgia, without regard to its conflict of laws rules. Any dispute will be resolved in the state or federal courts located in Georgia, and you consent to their jurisdiction.
